APPEAL COURT AFFIRMS UMAHI AS APC CANDIDATE FOR EBONYI SOUTH

A Court of Appeal in Abuja has affirmed Governor David Umahi as the validly elected candidate of All Progressives Congress (APC) for the Ebonyi south senatorial election.
Ann Agom-Eze challenged Umahi’s emergence as the APC candidate for the senatorial district.
On July 22, a Federal Hgh Court in Abakaliki dismissed a suit filed by Umahi, asking the court to recognise him as the APC candidate for the senatorial district.
The court subsequently ordered that a fresh primary election be conducted within 14 days.
The APC conducted a fresh primary election on July 31 and Umahi was declared the winner.
A few weeks after the loss, Agom-Eze was expelled from the APC over alleged rebellious and unruly behaviour.
Delivering judgment in the appeal filed by the governor, the appeal court held that the high court was wrong when it upheld Agom-Eze’s counter-affidavit.
The Appellate Court further held that the trial court erred when it failed to uphold the primary election of June 9 where Umahi was nominated as the APC senatorial candidate.
The Court averred that the nomination was never challenged by anybody within 14 days as stipulated by section 285(9) of the 1999 constitution.
Umahi described his journey to the National Assembly as the will of God.
The Governor, in a statement by his Media Aide, Chooks Oko expressed gratitude to God for the just delivered judgement of the Abuja Court of Appeal which confirmed him as the authentic flag bearer for APC Ebonyi South
The Governor also appreciated the citizens of the Senatorial district in particular, and the entire State for their prayers, steadfastness and goodwill which culminated in the victorious judgement.

TINUBU MOVES TO PACIFY ADAMU, GOVS WITH 2,000 APPOINTMENTS

 The ruling All Progressives Congress (APC), presidential candidate of the party, Asiwaju Bola Tinubu is planning to include an additional 2,000 members in the newly constituted Presidential Campaign Council of the party to pacify APC National Working Committee members and state governors who were dissatisfied with the 422-member campaign council.
It would be recalled that, the list of members released by Secretary of the Presidential Campaign Council, James Faleke, in Abuja, gear up crisis that leads to the postponements and conjectures about those who would be saddled with the task of leading the ruling party’s bid to retain power at the federal level.

The campaign council chaired by the President, Major General Muhammadu Buhari (retd.), has Tinubu and the APC national chairman, Adamu, as co-deputy chairman.
Also on the PCC are APC governors, ministers, lawmakers, ambassadors as well as serving and past public office holders.

Zonal and state coordinators, advisers, campaign patrons, directors, deputy directors and secretaries of directorates were also named.

The sub-committees include media and publicity; support group coordination; national youth mobilisation; parliamentarian; trade and economic; agriculturists/commodities; campaign planning; civil societies; Diaspora directorate; election planning and monitoring; finance; fundraising; and humanitarian/social.

However, the composition of the PCC did not reportedly go down well with some APC governors, especially Governors Ben Ayade of Cross River and AbdulRahman AbdulRazaq of Kwara State.
The governors were said to have expressed shock over the exclusion of their nominees after the painstaking efforts they took to identify potential candidates who could mobilise support and deliver votes for the party in the 2023 polls.

They were said to have tabled their grievances with the Chairman of the Progressive Governors Forum and Governor of Kebbi State, Atiku Bagudu and the national chairman of the APC, Adamu.

Members of the NWC also disowned the PCC list, saying the presidential candidate did not allow them to properly vet the names before he made the premature announcement.

While arguing that the composition of a presidential campaign council is something that ought to be done jointly by the candidate and the party, the aggrieved NWC members maintained that the list contains certain names that shouldn’t have been added because they have little or no electoral value.

When contacted on steps the party and its candidate are taking to address the grievances, the spokesperson for the APC Presidential Campaign Council, Festus Keyamo, confirmed that the list released on Friday was inconclusive.

Keyamo disclosed that the earlier published list contained names of leaders in each directorate, adding that a supplementary list of over 2,000 ‘membership cadre’ is on the way.

He said, “All their nominees will be included. The list was released in two parts. The one we released was the first one. In the coming days, more than 2,000 additional names will be released.”

On the difference between the membership cadre and the first, he said the first list contained the heads of each directorate.

He stated, ‘For instance, in my directorate which is ‘public affairs’, you will see only three names. And, of course, you know only three persons cannot run my department for the whole country.

‘Even under Bayo Onanuga in media and publicity, there are only three or four names there. That also cannot run a whole campaign.

‘Now, what we are saying is that with the release of the membership cadre, we will now have more than 100 people under each directorate, including mine.

‘That’s why I said there is absolutely nothing to fear. The 422-member list is not all the people nominated for our campaign. You know we are more organised than those other people who are falling every day. So, don’t worry.’’

On concerns raised by the APC NWC members that they were not permitted to properly vet the list before it was unveiled to the public, the Senior Advocate of Nigeria noted that there was no iota of truth in the report.


PDP DEPUTY NATIONAL CHAIRMAN, TWO VICE CHAIRMEN, WOMEN LEADER RETURN N120M 'BRIBES' PAID INTO THEIR BANK ACCOUNTS AS CRISIS WORSENS

Four members of the National Working Committee (NWC) of the Peoples Democratic Party (PDP) have returned about N120million paid into their accounts by the leadership of the party.

The party officers are the Deputy National Chairman (South) Taofeek Arapaja; National Vice Chairman (South South), Chief Dan Orbih; National Vice Chairman (South West) and National Women Leader, Prof. Stella Affah-Attoe.

While Arapaja got N36 million of the said money transferred into his bank account, the three others got N28.8 million each.
“I observed a malicious story reported in the Nations Newspaper of 26th September, 2022; where it was alleged that members of the National Working Committee were offered humongous amount of money to silent us over an allegation of financial misappropriation to the tune of fifteen billion Naira (N15,000,000,000).

“This led me to browse my phone through various alerts and I discovered a transfer of Thirty-Six million Naira (N36,000,000) from the party. I have personal reservation about the money transferred to my account and for personal reasons wish to return it accordingly,” the letter signed by Arapaja to the PDP National Chairman read.

The PDP has been in turmoil since former Vice-President Atiku Abubakar was elected as the standard bearer of the major opposition party.
The rift deepened after Nyesom Wike, governor of Rivers State, was overlooked by Atiku in the selection of his running mate.
The crisis worsened as Wike’s allies jettisoned campaign responsibilities, and insisted that Iyorchia Ayu, the party’s National Chairman, must be removed.
“I hereby inform you of the refund of the Sum of Twenty Eight Million Eight Hundred Thousand Naira (#28,800,000:00) back to the Peoples Democratic Party, Account Number: 1000095003 at Globus Bank PLC. The receipt of the payment back to the account is attached,” Effah-Attoe in her letter said.

The letter read, “When I enquired from your Office, I was told that the said sum is for Two
(2) years House Rent for me, as a member of The National Working Committee.

“Since after the lodgment of the money into my Bank Account, I have been inundated with many phone calls from Party members, friends, family members and the general public, insinuating that the said money has been given as a Bribe to bring me and other NWC members on the side of The National Chairman, following the crisis between him on one side and the Governor of Rivers State, H.E Governor Nyesom Wike/ Wike’s Group on the other side.
“In addition, some National Newspapers/Social Media Platforms have also carried stories accusing the NC members of being placated with Bribe of N28,800,000.00.

SUPREME COURT DISMISSES SUIT CHALLENGING THE AUTHENTICITY OF ADELEKE'S CANDIDACY IN THE JUST CONCLUDED OSUN GOVERNORSHIP ELECTION

The Supreme Court has dismissed the suit challenging the authenticity of Ademola Adeleke’s candidacy in the just concluded Osun State Governorship Election in South-West Nigeria.

The suit was instituted by Dotun Babayemi, a former governorship aspirant of the Peoples Democratic Party in Osun.

In a judgement delivered by Justice Amina Augie, the five-member panel held that the court lacked jurisdiction to hear the suit after counsel for the appellant, Adebayo Adelodun, withdrew the earlier notice of appeal that was filed within time.

At the resumed hearing, Adelodun, who represented the appellant and Babayemi informed the court that he sought to withdraw the earlier notice of appeal to replace it with the fresh application he filed.

But the panel held that Section 285(11) of the constitution stipulated that an appeal on a pre-election matter must be filed within 14 days from the day of the decision, and that having filed the second appeal out of time, the apex court lacked jurisdiction to entertain the matter.

Justice Augie, therefore, dismissed the appeal for lack of jurisdiction.

Babayemi had asked the court to invalidate the primary election that produced the governor-elect, citing non-compliance with a court order.

In his judgment on the matter, on May 18, Justice Nathaniel Ayo-Emmanuel of a Federal High Court, Osogbo, had upheld the governorship primary that produced Adeleke.

Also, the Court of Appeal, Akure Division, in its judgment of July 20 on the appeal filed against the decision of the Federal High Court, Osogbo, aligned with the lower court and dismissed Babayemi’s appeal.

After his victory at the party’s primary, Adeleke trounced Governor Gboyega Oyetola of All Progressives Congress at the governorship election in the state.

The Independent National Electoral Commission in July said Adeleke won 17 of the 30 local government areas during the election whilst Oyetola who sought re-election won 13 local governments.

Asiwaju Bola Ahmed Tinubu, the presidential candidate of the All Progressives Congress (APC), has come under criticism as he was missing at Thursday’s signing of the Peace Accord.

OYETOLA'S MASS RECRUITMENT, ANOTHER PLOT TO STRANGULATE OSUN STATE– ADELEKE .

The Ademola Adeleke Transition Committee has learned of another another mass recruitment drive being conducted by Mr. Gboyega Oyetola as part of his continued efforts to bankrupt Osun state and further embroil the state in debt before November 27.

According to reliable sources, the leaving administration has started hiring 500 health professionals through the Executive Secretary for the Osun State Primary Health Care Board, who was also recently appointed without the necessary credentials. The mysterious recruiting serves as a cover for a calculated scheme to boost governmental payroll and obstruct measures to improve the state’s finances.

“A few weeks ago, the departing administration began hiring 1,500 teachers on the spot while pretending to fill open positions.

In reality, this was part of a larger strategy to financially cripple the incoming administration. The activity lacks the requisite manpower planning and development plans, making it as usual a job for the lads.

“The outgoing governor has also been giving multibillion naira capital projects without contracts and in conformity with procurement law, which serves to substantiate the nefarious motivation.

More than three of these contracts have reportedly been awarded in the past two weeks. The contracts intended to intimidate the incoming government are typically given to known friends of the governor.

“As a result, when we learned that more medical professionals were being hired in defiance of the law and accepted procedures, we were not shocked.

Although the transition committee acknowledges the state’s high unemployment rate, it issues a warning against “a persistent attempt to use the suffering of the populace to further a sinister political objective of cutting short the agenda of resurrection and rebuilding for the new administration.

“We implore the residents of Osun State not to fall for the Oyetola team’s most recent tricks. All hiring decisions made in violation of the strategy for personnel planning and with the express purpose of planting a time bomb for the next elected governor are unacceptable.

All contracts awarded under dubious conditions will likewise be given the proper review when it is necessary. We urge everyone who is impacted to refrain from acting as tools in a defeated governor’s political vendetta by refusing to yield to the will of the people, the statement said.

The committee claimed that “the outgoing government is only using its last minutes in Government House to set traps and lay mines for a government of the people knocking at the door,” assuring the people of Osun state of a well-thought-out plan by the incoming Adeleke government to sustainably address issues of workers’ welfare, job creation, insecurity, infrastructure deficit, and others facing the state.

The statement added, “Osun people must rise against anti-people acts and deeds such the numerous attempts to exacerbate the state’s financial problems through deliberate growth of the public payroll and engagement of contractual commitments that violate procurement regulations.

BREAKING: NECO RELEASES 2022 SSCE RESULTS

The National Examinations Council has released the 2022 Senior Secondary School Certificate Examination results.

NECO Registrar, Prof. Dantani Wushishi, announced the results on Thursday at the NECO Headquarters in Minna, Niger State.

Aside from the results, Wushishi said the council blacklisted 29 supervisors for their alleged involvement in various malpractice offences.

According to him, the decline in malpractice during the examination was appreciable.

In the area of malpractices, 13, 595 were caught as against 20, 003 in year 2021, which showed appreciable decline in number of malpractices cases.”


“Twenty nine supervisors were blacklisted for various offended ranging from poor supervision, insult, aiding and abetting during the examinations”.


Dantani gave the number of candidates that registered for the Examinations as 1, 209, 703 while 1, 198, 412 sat for the examination.


He further stated that the number of candidates who got five credits and above, including English Language and Mathematics is 727, 864 representing 60.74 per cent.

He also said four schools were recommended for de-recognition for two years over consistent malpractices.

Meanwhile, Wushishi revealed that the council recorded a decline in malpractice in the 2022 internal senior school certificate examinations as against other years.

EIGHT KILLED, TWO INJURED IN KOGI ROAD CRASH

The Federal Road Safety Corps (FRSC) Kogi State Command has confirmed the death of eight persons in an accident that occurred in Ankpa, Kogi State.

Kogi FRSC Sector Commander Stephen Dawulung who confirmed the incident said that a fuel tanker, three cars and three motorcycles were involved in the accident.

According to him , the accident occurred when a tanker loaded with fuel failed brake and crushed three vehicles, including three motorcycles before fallen into a bridge and caught fire

He stated that the accident occured around eleven thirty (11;30am) in the morning killed eight persons while two other persons are rescued alive and are taken to the hospital in Ankpa town for treatment.

He also disclosed that eight corpses were also recovered from the scene of the accident.

The Sector Commander urged fuel tanker drivers to install Safety valve in the vehicles to prevent spillage of fuel during mishaps.

He aslo charged the drivers to comply with the actual carrying capacity of the truck to avoid over loading and cautioned them against allowing their motor boys to drive the vehicle when ever it is loaded with fuel.

APC CHAIRMAN ABDULLAHI ADAMU FUMES ACCUSES HIM OF BREACHING AGREEMENT ON CAMPAIGN COUNCIL

The alleged face-off between the members of the National Working Committee (NWC) of the All Progressives Congress (APC) and the Presidential Campaign Council (PCC) blew open on Thursday, with the party’s National Chairman, Senator Abdullahi Adamu writing the party’s presidential candidate, Asiwaju Bola Ahmed Tinubu, accusing the Campaign Council of working unilaterally.
 Ben Ayade, North West APC Governors threatened to withdraw support for Tinubu.

The letter is coming a few days after the Presidential Campaign Council suspended all its activities scheduled before the commencement of the Presidential Campaign, which was officially supposed to have kicked off on Wednesday.

In the letter addressed to the APC presidential candidate titled: “Release of the Tinubu/Shettima Presidential Campaign Council listing”, Adamu accused Tinubu of breaching an agreement reached with the National Working Committee (NWC) members, he therefore asked for the council’s restraint from further actions.

According to him, both the committee set up by NWC and PCC should have reconciled the list before its released but this was not done.

FEDERAL HIGH COURT SACKS ADAMU ALIERO AS PDP SENATORIAL CANDIDATE

The Federal High Court in Birnin Kebbi, Kebbi State, Tuesday, nullified the election of Adamu Aliero, a former Governor of Kebbi State, as the senatorial candidate of the Peoples Democratic Party (PDP) for Kebbi Central District.
The trial judge, Babagana Ashigar, ruled in favour of Haruna Sa’idu.

Sa’idu argued that he is the bona fide senatorial candidate of the PDP for the Kebbi Central District.

He sued Aliero, the incumbent senator of the district, the PDP and the Independent National Electoral Commission (INEC) for conducting a fresh primary for the Kebbi Central Senatorial District.

According to him, the fresh primary contravened the Electoral Act 2022.

Sa’idu argued that he was alive and didn’t withdraw from the contest, adding that his name was unlawfully substituted with that of Aliero, who defected from the All Progressives Congress (APC) to the PDP after a primary election was conducted.

However, Asghigar observed that when the first primary for the district was held, Aliero was in the APC.

The judge, however, ruled that based on exhibits 2,21,23,24 tendered before the Court, Sa’idu participated in the first primary, where he was elected as the candidate, having scored the highest votes while the first defendant, Aliero, was still at the ruling party.

“Since the first primary election was not challenged by the 1st defendant, it is in my humble view that the first primary election for Kebbi Central Senatorial district remained authentic

“I, therefore, upheld all the prayers of the plaintiff,” Asghigar ruled.

JUST IN: COURT CERTIFIES BASHIR MACHINA AS YOBE NORTH SENATORIAL CANDIDATE

The Damaturu Division of the Federal High Court on Wednesday affirmed Bashir Sheriff Machina as the All Progressives Congress’ senatorial candidate for Yobe North.
Justice Fadima Aminu said the Independent National Electoral Commission (INEC) should immediately publish Mr Machina’s name as the ruling party’s candidate in the district’s 2023 National Assembly election.
The judge also said Mr Machina was duly elected senatorial candidate for APC, consequently upholding the May 28 primary election of the party that was also certified by INEC.

Bashir Machina’s mandate was threatened by Senate President Ahmad Lawan, who tried to exploit his relationship with the party leaders to overturn an already certified primary election.

CAMPAIGNING IN MOSQUES, CHURCHES IS ILLEGAL ...AJULO

A constitutional lawyer Kayode Ajulo has warned Nigerian politicians and political parties against disobeying the provisions of the Electoral Act 2022 during campaigns ahead of the 2023 general elections.

Mr Ajulo reminded candidates stated that the Electoral Act placed restrictions  been placed to prevent the usual electoral malpractices that start even from the period of the campaign.
“Places designated for religious worship, police stations and public offices shall not be used for political campaigns.

Kayode Ajulo, a constitutional lawyer has warned Nigerian politicians and political parties against disobeying the provisions of the Electoral Act 2022 during campaigns ahead of the 2023 general elections.

Mr Ajulo reminded candidates stated that the Electoral Act placed restrictions  been placed to prevent the usual electoral malpractices that start even from the period of the campaign.

“Section 92 of the Electoral Act, 2022, provides for prohibition of certain conduct at political campaigns,” he noted.
Mr Ajulo explained that a political campaign or slogan should not be tainted with abusive language directly or indirectly likely to injure religious, ethnic, tribal or sectional feelings.
According to him, abusive, intemperate, slanderous or bias language or insinuations or innuendoes designed or likely to provoke violent reaction or emotions should not be used in political campaigns.

He said places designated for religious worship, police stations and public offices should not be used for political campaigns.

“By the above provision prohibiting the use of public offices for election campaigns, it is safe to submit that palaces of our traditional rulers that are maintained with public funds are categorised as public offices,” he stated.

The lawyer said a credible election remained the basis for conferring legitimacy on any government in a democratic dispensation.
Section 92(3) of the act says, “Places designated for religious worship, police stations and public offices shall not be used for political campaigns, rallies and processions; or to promote, propagate or attack political parties, candidates or their programmes or ideologies.”

Festus Okoye, INEC commissioner had earlier warned politicians against campaigning in churches, mosques and other public places.

The campaign train of the Peoples Democratic Party (PDP) comprises 325 members with Governor Udom Emmanuel as the director-general, while the campaign team of the All Progressives Congress (APC) consists of 442 members with President Muhammadu Buhari as chairman.

Campaigns for the 2023 elections kicked off today, according to the INEC timetable.
The major focus of the election is the presidential race involving Bola Tinubu (APC), Atiku Abubakar (PDP), Rabiu Kwankwaso (NNPP) and Peter Obi (Labour Party).

APC BROUGHT HARDSHIP TO NIGERIA.. AKEREDOLU EX-COMMISSIONER


Governor Rotimi Akeredolu’s former ally and ex-water resources commissioner Yetunde Adeyanju has urged APC members to leave the ruling party, accusing it of bringing hardship on Nigerians as she and scores of APC supporters in Ondo defected to the Peoples Democratic Party (PDP) ahead of the 2023 general elections.

Mrs Adeyanju led the decampees at an event on Monday held at the PDP secretariat in Ore, Odigbo local government. 

“The APC has brought so much suffering to the people, and anybody with sympathy for the people must exit the party,” Mrs Adeyanju said.

Receiving the defectors, the PDP chairman in Ondo, Fatai Adams, said the party would be willing to receive more people into its fold ahead of the election. 

Mr Adams expressed optimism that the PDP would return to power in 2023 and advised the defectors to support the party in their local areas. 

Mrs Adeyanju, a prominent grassroots politician, resigned in July from Governor Rotimi Akeredolu’s cabinet after being moved from the water resources ministry to the planning and urban ministry. 

She was the leader of the women’s groups for Mr Akeredolu’s campaign during the 2016 and 2020 governorship elections.

ORTOM BREAKS AWAY FROM Wike’s ALLIES, SAYS ‘I WANT AYU AS CHAIRMAN'

Samuel Ortom, governor of Benue state, says he is not among those calling for the removal of Iyorchia Ayu as the national chairman of the Peoples Democratic Party (PDP).

Ortom’s statement contradicts that of Nyesom Wike, governor of Rivers, and his allies, which he was a part of.
Since the election of former Vice-President Atiku Abubakar as the standard-bearer of the party in May, the group has insisted that Ayu must resign as a condition for supporting the PDP presidential candidate.
In a statement issued by Nathaniel Ikyur, his chief press secretary, Ortom said he has confidence in Ayu’s ability to lead the party to victory in next year’s general election.

The governor was reacting to the allegations by Jemgbagh Development Association, Abuja that he was plotting the downfall of his fellow Benue man, Ayu.

He said he worked tirelessly, alongside other prominent Benue citizens, to ensure that Ayu was elected “as the national chairman of our great party even against all odds”.
“The governor could not, therefore, turn around to work against him to be removed from office,” the statement reads.

“Governor Ortom vouched for the integrity and capacity of Dr Iyorchia Ayu to lead and rebuild the PDP to victory and rescue Nigeria from the misrule of the APC maladministration. That is why Ayu was returned unopposed by the northern caucus of the party and got elected as the national chairman of the PDP at the party’s convention.

“Where was Jemgbagh Development Association, when Governor Ortom galvanised support from across the leaders of the party to make Dr. Ayu PDP’s National Chairman? What was their contribution to that project that they now want to use clannish stance to blackmail the governor?

“This amorphous and emergency Jemgbagh Development Association, Abuja, which has never been heard of before, is now masquerading as the voice of Jemgbagh to embark on campaign of calumny against Governor Ortom, who has worked selflessly for the people of Benue State.

APC POSTPONES CAMPAIGN KICK OFF TILL FURTHER NOTICE

The All Progressives Congress, APC, Presidential Campaign Council on Tuesday, said it has postponed the kick-off of its campaigns earlier slated for Wednesday.

The development was disclosed by the Director-General, of the Tinubu/Shettima Presidential Campaign Council and Governor of Plateau State, Simon Lalong.
The statement stated that the adjustment of timetable followed the move to expand the campaign council list to accommodate more stakeholders.

The Governor noted that a new date for the kick-off would be announced soon.

Strike: WHY FG MADE U-TURN ON REOPENING OF UNIVERSITIES

The President Muhammadu Buhari-led Federal Government has assured that the ongoing strike by the Academic Staff Union of Universities, ASUU, will soon be over.

 Minister of State for Education, Goodluck Opiah  assured that Buhari’s administration is committed to ending the ASUU strike.

Opiah gave the assurance in Owerri, Imo State, while addressing journalists over the weekend.

“I can assure you that the government is very concerned about the situation. Even as I speak to you now a lot of thinking, a lot of discussions and meetings are going on with a view to resolving the matter as quickly as possible.

“I am hopeful that the disagreement between the government and ASUU will be resolved soon so that our children can go back to school”.

ASUU has been on strike since February 2022 over face-off with the Federal Government due to mode of payment for university lecturers.

SARAKI LEADS ATIKU/OKOWA 2023 PRESIDENTIAL CAMPAIGN ADVISORY COMMITTEE

Beraly two days to the commencement of the 2023 election campaign, the presidential candidate of the Peoples Democratic Party and former Vice President of Nigeria, Atiku Abubakar has made key appointments of Special Advisers aimed at strengthening his presidential campaign team.
 
The appointees are former Senate Presidents, Dr. Abubakar Bukola Saraki as Special Envoy to the presidential candidate and Senator Pius Anyim, as Special Adviser.
 
Also appointed as Special Advisers to the candidate are former governor of Kano State, Senator Ibrahim Shekarau, former governor of Osun State, Prince Olagunsoye Oyinlola and Senator Ehigie Uzamere.
 
Former national chairman of the Peoples Democratic Party (PDP), Prince Uche Secondus was also appointed as Technical Adviser to the presidential candidate. 
 
The appointments are to take immediate effect.
 
Atiku Abubakar charged the appointees to use their vast political experiences in ensuring that the PDP presidential campaign records resounding success in the 2023 election.
